constructive desertion

Conduct of a respondent equivalent to the expulsion of a petitioner from the matrimonial home with the intention of ending consortium. It is conduct equivalent to driving the other spouse away : Examples: husbands adultery: husbands accusing wife of immorlity and telling her to go; treasonable activities of wife resulting in her conviction (legram v Ingram [1956] P 390). It may be an indication-of irrectriveable breakdown of marriage and grounds for proceedings leading to, e.g., separation and maintenance.
